Structured settlements are becoming increasingly popular today. They manage to solve lots of different problems at once when it comes to tort law. Often times, lawyers are more willing to go along with structured settlements than the traditional lump sum settlements that people would usually receive in tort cases.

Tort law is much more complicated than a lot of people think in an era where joking about frivolous lawsuits is so common. People seem to think that a tort lawsuit is something of a get-rich-quick scheme that actually works. In fact, people are more likely to lose money in personal injury lawsuits, particularly if the personal injury lawsuit is filed against a large and powerful corporation with high-priced lawyers.

Many of the allegedly frivolous lawsuits are only framed that way by the media. The woman who sued a restaurant over hot coffee actually sustained third degree burns as a result of accidentally spilling the hot coffee, so the people who objected to that lawsuit are more or less saying that it's all right for restaurants to put their customers at risk for sustaining potentially fatal burns. However, many of the people who try to address similar grievances in personal injury lawsuits often fail in the process, particularly if they are expecting a lump sum settlement.

Structured settlements have a lot of benefits for the recipients. People aren't always responsible with large sums of money that they receive all in one sitting. Far too many people end up spending a lot of their money too quickly in situations like this. The people who receive structured settlements are going to receive the payments according to a predetermined schedule. As such, these payments are almost going to act like something of a supplementary income for them. From a financial perspective, these sorts of payments can be better in the long run.

However, there are exceptions. In some cases, structured settlements can put people at something of a disadvantage. For one thing, in personal injury lawsuits, people will often use the settlements to pay off all of their various medical expenses. Sometimes, medical expense payments are included separately. In other cases, people will not be able to pay them off with anything other than the settlement, which means that they're relying on the money from the settlements to a certain extent.

Medical expenses can sometimes be addressed on something of a payment plan, which is what some people who receive structured settlements will arrange in the right situation. However, having medical expenses hanging over one's head for a long period of time, which will often be the case where large settlements and extensive injuries are involved, can be a stressful. Structured settlements can prolong the reward period, but they can also prolong the emotional costs and make it harder for people to feel as if they have fully gotten on with their lives. Still, getting a settlement in the first place will make all the difference in the world for many victims of personal injury, and they may ultimately be best.
